Brian Mullin’s practice is focused on the representation of management in employment related matters, including discrimination and wrongful termination claims, contract disputes, wage-and-hour complaints, non-competition and protection of trade secrets, union organization, grievances and arbitration. His experience includes representation of clients before state and federal courts, arbitrators and various state and federal agencies, including the Massachusetts Commission Against Discrimination, the U.S. Equal Employment Opportunity Commission, U.S. Department of Labor, OFCCP, Department of Transportation, OSHA, and the NLRB.

Brian regularly counsels clients on day-to-day personnel and compliance matters including leaves of absence, wage & hour compliance, protecting trade secrets and confidential information, Affirmative Action and EEO programs, reductions in force, union avoidance and conducting investigations. He develops and implements drug testing, safety and training programs and drafts handbooks and employment related agreements including employment, compensation, confidentiality, non-competition and separation agreements. 

Brian provides his higher education clients with advice and counsel on a broad range of matters including those specific to colleges and universities such as representation before the U.S. Department of Education Office of Civil Rights, student and faculty issues, Title IX, Section 504, ADA, VAWA, and the Cleary Act.

Background: 

Before becoming an attorney, Brian worked for many years as a human resource executive, gaining experience in several industries including real estate development, finance, telecommunications and the public sector. Brian was an associate in the labor and employment group of McCarter & English (formerly Gadsby Hannah) before joining Bowditch & Dewey in 2009.

Brian retired from the military after more than 20 years of service, including active service in the United States Marine Corps.
