So, What Do We Do Now? Title IX in the Time of Trump

Since taking the reins of power in January, President Trump has begun to unravel many regulations and other initiatives put in place by the Obama Administration. The Department of Education has been at the forefront of this effort. Secretary DeVos recently announced, among other things, a “review” of Obama-era guidance on Title IX enforcement for sexual assault on campus, and that guidance has now been rescinded. This has left institutions to grapple with difficult questions on how to best meet their compliance responsibilities and how to balance the shifting enforcement landscape against existing – and potentially changing – expectations from various members of the campus community, including victims and those accused of committing sexual assault.

Drawing on recent regulatory guidance and case law, this seminar will explore the current state of Title IX enforcement and offer predictions on what the changing enforcement landscape will mean going forward.
