Massachusetts Non-Competes: Alive, Dead, or on Life Support?

Over the last 10 years, there have been numerous legislative attempts in Massachusetts to limit – and in some cases do away with – non-compete agreements. All of them have stalled, and the law in this area remains largely judge-made. However, in recent months, several bills have been filed that appear to have a significant amount of overlap, suggesting that 2018 may be the year that a consensus emerges around comprehensive legislative reform when it comes to enforcement of these post-employment restrictions.

This seminar is a ‘must-attend’ for any employer who uses non-competes in its workplace. It is ideally suited to senior level management and HR professionals who grapple with employees’ post-employment obligations, and how to enforce them, as well as senior level executives who are subject to non-competes and have questions regarding their enforceability. Topics addressed in this seminar will include, among others:

  • The current lay of the land in Massachusetts when it comes to non-compete enforcement.
  • Common mistakes employers make when trying to enforce their non-competes against departing employees (and strategies on how to enforce a non-compete agreement without full-blown litigation).
  • An overview of current legislative attempts to reform non-compete law in Massachusetts.
  • Steps employers should consider taking now to protect their interests going forward.

Speakers:

  • Stephen J. Coukos, Executive Vice President & General Counsel, Cambridge Savings Bank (April 3rd only)
  • Mark A. Mosby, Chief Legal Counsel, Fallon Health (April 6th only)
  • Timothy P. Van Dyck, Practice Area Leader, Labor & Employment Group, Bowditch
  • Robert G. Young, Partner, Labor & Employment Group, Bowditch
