Maria Remillard Quoted in Massachusetts Lawyers Weekly’s “Appeals Court OKs delay in husband’s alimony reduction”

In a recent court case, a Probate & Family Court judge granted a modification to the husband’s alimony due to a change in circumstances. The husband and his business partner sold their business, resulting in the husband’s reduced salary. Massachusetts Lawyers Weekly spoke with Maria Remillard about her stance on the case, including the inconsistency she believes it creates.

“This holding effectively obligated this payor to utilize a portion of his capital gains, dividends and interest income derived from assets received in a divorce to satisfy the alimony obligation until the termination of the receipt of such income,” Remillard said. “Only then did he receive a reduction in the support obligation. This result does not appear to be consistent with the intent of the Alimony Reform Act.”
