The Real Reporter Publishes “Do U.S. Fair Housing Policies Require Renting to Criminals?” by Joe Ransom

The Real Reporter published an article by Joe Ransom on May 4 discussing recent guidance issued by the U.S. Department of Housing and Urban Development regarding landlords’ policies of accepting or denying a rental application based on an individual’s criminal history. Due to varying incarceration rates among different races and national origins, a landlord’s policy to deny rental to potential tenants with criminal records may be inherently discriminatory. Although a landlord may typically consider criminal history in housing decisions, its policies must consider factors beyond the simple existence of a criminal record.
