{"id":1381,"date":"2020-05-18T22:25:40","date_gmt":"2020-05-18T22:25:40","guid":{"rendered":"https:\/\/www.bowditch.com\/bowditchrealestateblog\/?p=1381"},"modified":"2022-05-19T12:46:29","modified_gmt":"2022-05-19T16:46:29","slug":"mandatory-self-certification-and-industry-specific-guidance-for-massachusetts-essential-and-phase-one-businesses","status":"publish","type":"post","link":"https:\/\/www.bowditch.com\/bowditchrealestateblog\/2020\/05\/18\/mandatory-self-certification-and-industry-specific-guidance-for-massachusetts-essential-and-phase-one-businesses\/","title":{"rendered":"Mandatory Self-Certification and Industry-Specific Guidance For Massachusetts Essential And Phase One Businesses"},"content":{"rendered":"<p>On May 18, 2020, Governor Baker released <a href=\"https:\/\/www.mass.gov\/doc\/reopening-massachusetts-may-18-2020\/download\" target=\"_blank\" rel=\"noopener noreferrer\"><em>Reopening Massachusetts<\/em><\/a>, the Reopening Advisory Board\u2019s report that\u00a0details Massachusetts\u2019 four-phased strategy to reopen in-state businesses and activities.\u00a0 Starting on May 18, Massachusetts will begin Phase One of its reopening plan.\u00a0 Here is some important reopening information for Massachusetts employers:<\/p>\n<h2>Phase One Businesses Eligible to Reopen<\/h2>\n<p>Manufacturing and construction businesses and places of worship are eligible to reopen beginning May 18.<\/p>\n<p>Beginning May 25, the following businesses are eligible to reopen:<\/p>\n<ul>\n<li>Laboratory and life science facilities;<\/li>\n<li>Offices, excluding those in the City of Boston; work from home is strongly encouraged and businesses should restrict workforce presence to no more than 25% maximum capacity. Boston offices can reopen on June 1, following applicable guidelines for the rest of the state.<\/li>\n<li>Hair salons and barbershops, by appointment only;<\/li>\n<li>Pet grooming, by appointment only (with curbside pet drop-off and pick-up);<\/li>\n<li>Car washes, with exterior car washing allowed;<\/li>\n<li>Recreation and outdoor activities, with guidelines;<\/li>\n<li>Retail, with remote fulfillment and curbside pickup.<\/li>\n<\/ul>\n<p>To reopen, all businesses must adhere to the <a href=\"https:\/\/www.mass.gov\/info-details\/reopening-mandatory-safety-standards-for-workplaces\" target=\"_blank\" rel=\"noopener noreferrer\">Massachusetts Mandatory Safety Standards<\/a> and any applicable <a href=\"https:\/\/www.mass.gov\/info-details\/reopening-massachusetts#sector-specific-protocols-and-best-practices-\" target=\"_blank\" rel=\"noopener noreferrer\">industry-specific guidance<\/a> (see below).\u00a0 Further, businesses must complete the three-part mandatory self-certification process set forth below.<\/p>\n<p>All essential businesses can continue to stay open and operate.\u00a0 However, essential businesses now must comply with the Mandatory Safety Standards and any applicable industry-specific guidance, and must also complete the three-part self-certification process by May 25, 2020.<\/p>\n<h2>Mandatory Self-Certification Process for Essential and Phase One Businesses<\/h2>\n<p>To reopen (or to stay open, for essential businesses), businesses must complete the following self-certification process:<\/p>\n<ol>\n<li>Develop a written COVID-19 Control Plan outlining how the business will prevent the spread of COVID-19;\n<ul>\n<li>To complete this step, business can <a href=\"https:\/\/www.mass.gov\/doc\/covid-19-reopening-control-plan-template\/download\" target=\"_blank\" rel=\"noopener noreferrer\">fill out this template<\/a>. Control plans do not need to be submitted for approval but must be kept on premise and made available in the case of an inspection<\/li>\n<\/ul>\n<\/li>\n<li>Sign and post a \u201c<a href=\"https:\/\/www.mass.gov\/doc\/compliance-attestation\/download\" target=\"_blank\" rel=\"noopener noreferrer\">Compliance Attestation Poster<\/a>,\u201d\u00a0in an area visible to employees and visitors; and<\/li>\n<li>Post \u201c<a href=\"https:\/\/www.mass.gov\/doc\/employer-reopening-poster\/download\" target=\"_blank\" rel=\"noopener noreferrer\">Employer<\/a>\u201d\u00a0and \u201c<a href=\"https:\/\/www.mass.gov\/doc\/employee-reopening-poster\/download\" target=\"_blank\" rel=\"noopener noreferrer\">Worker<\/a>\u201d\u00a0posters describing the rules for maintaining social distancing, hygiene protocols, cleaning, and disinfecting.<\/li>\n<\/ol>\n<h2>Industry-Specific Guidance<\/h2>\n<p>Currently, the following industries must adhere to sector-specific protocols in addition to the Mandatory Safety Standards:<\/p>\n<ul>\n<li><a href=\"https:\/\/www.mass.gov\/lists\/safety-standards-for-construction\" target=\"_blank\" rel=\"noopener noreferrer\">Construction<\/a><\/li>\n<li><a href=\"https:\/\/www.mass.gov\/lists\/safety-standards-for-manufacturing\" target=\"_blank\" rel=\"noopener noreferrer\">Manufacturing<\/a><\/li>\n<li><a href=\"https:\/\/www.mass.gov\/lists\/safety-standards-for-office-spaces\" target=\"_blank\" rel=\"noopener noreferrer\">Office Spaces<\/a><\/li>\n<li><a href=\"https:\/\/www.mass.gov\/lists\/safety-standards-for-laboratories\" target=\"_blank\" rel=\"noopener noreferrer\">Laboratories<\/a><\/li>\n<li><a href=\"https:\/\/www.mass.gov\/lists\/safety-standards-for-hair-salons-and-barbershops\" target=\"_blank\" rel=\"noopener noreferrer\">Hair Salons and Barbershops<\/a><\/li>\n<li><a href=\"https:\/\/www.mass.gov\/lists\/safety-standards-for-car-washes\" target=\"_blank\" rel=\"noopener noreferrer\">Car Washes<\/a><\/li>\n<li><a href=\"https:\/\/www.mass.gov\/lists\/safety-standards-for-pet-grooming-services\" target=\"_blank\" rel=\"noopener noreferrer\">Pet Grooming<\/a><\/li>\n<\/ul>\n<p>There is also separate, additional guidance for <a href=\"https:\/\/www.mass.gov\/lists\/safety-standards-for-places-of-worship\" target=\"_blank\" rel=\"noopener noreferrer\">places of worship<\/a> and <a href=\"https:\/\/www.mass.gov\/info-details\/executive-office-of-energy-and-environmental-affairs-eea-covid-19-guidance-documents\" target=\"_blank\" rel=\"noopener noreferrer\">outdoor recreation<\/a>.<\/p>\n<h2>Client Tip<\/h2>\n<p>In addition to the above, beginning May 18, acute care hospitals and community health centers that attest to specific public health\/safety standards can begin to provide high-priority preventative care, pediatric care, and treatment for high-risk patients.\u00a0 Beginning May 25, the same conditions apply to other health care providers.\u00a0 <a href=\"https:\/\/www.mass.gov\/lists\/reopening-health-and-human-services-in-massachusetts.\" target=\"_blank\" rel=\"noopener noreferrer\">Click here\u00a0for applicable guidance from the Executive Office of Health and Human Services.<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>On May 18, 2020, Governor Baker released Reopening Massachusetts, the Reopening Advisory Board&rsquo;s report that&nbsp;details Massachusetts&rsquo;
