Prot. Agency<\/em><\/a>, U.S., No. 21-454 (May 25, 2023), the U.S. Supreme Court held that the proper test for determining whether wetlands are \u201cwaters of the United States\u201d within the meaning of the federal Clean Water Act (CWA) 33 U.S.C. \u00a71251 et seq. (1972) was determined by the plurality in <em>Rapanos v. United States<\/em>, 547 U.S. 715, 739, 126 S. Ct. 2208, 2225 (2006), i.e., that the phrase \u201cthe waters of the United States\u201d includes only those relatively permanent, standing or continuously flowing bodies of water \u201cforming geographic features\u201d that are described in ordinary parlance as \u201cstreams[,] &#8230; oceans, rivers, [and] lakes.\u201d<\/p>\n<p>While the Court was unanimous on the point that the CWA did not apply to the Sackett\u2019s lot, the Court was split on the reasoning.\u00a0 The minority noted that the Court\u2019s new test may be just as vague as the test it sought to replace and that \u201c[b]y narrowing the Act\u2019s coverage of wetlands to only adjoining wetlands, the Court\u2019s new test will leave some long-regulated adjacent wetlands no longer covered by the Clean Water Act, with significant repercussions for water quality and flood control throughout the United States.\u201d<\/p>\n<p>The Court\u2019s decision effectively limits the scope of the Environmental Protection Agency&#8217;s and Army Corps of Engineers\u2019 jurisdiction over certain wetlands. It is anticipated that both agencies will need to revisit guidance dated June 5, 2007, under which the two agencies adopted the now outdated <a href=\"https:\/\/www.epa.gov\/sites\/default\/files\/2016-04\/documents\/rapanosguidance6507.pdf\" target=\"_blank\" rel=\"noopener\">&#8220;significant nexus&#8221; test articulated in <em>Rapanos<\/em><\/a>. The EPA\u2019s website now shows a new post that \u201cIn light of [the <em>Sackett<\/em>] decision, the agencies will interpret the phrase <a href=\"https:\/\/www.epa.gov\/wotus\" target=\"_blank\" rel=\"noopener\">&#8216;waters of the United States&#8217;<\/a> consistent with the Supreme Court\u2019s decision in\u00a0<em>Sackett<\/em>.
