{"id":67,"date":"2013-09-24T12:33:48","date_gmt":"2013-09-24T16:33:48","guid":{"rendered":"https:\/\/www.bowditch.com\/bowditchrealestateblog\/?p=67"},"modified":"2020-07-31T13:26:54","modified_gmt":"2020-07-31T13:26:54","slug":"who-is-required-to-notify-massdep-of-a-release-of-oil-or-hazardous-material","status":"publish","type":"post","link":"https:\/\/www.bowditch.com\/bowditchrealestateblog\/2013\/09\/24\/who-is-required-to-notify-massdep-of-a-release-of-oil-or-hazardous-material\/","title":{"rendered":"Who is required to notify MassDEP of a release of oil or hazardous material?"},"content":{"rendered":"<p><a href=\"https:\/\/www.bowditch.com\/commercial\/wp-content\/uploads\/sites\/4\/2013\/09\/ManClipboard.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"size-thumbnail wp-image-68 alignleft\" src=\"https:\/\/www.bowditch.com\/commercial\/wp-content\/uploads\/sites\/4\/2013\/09\/ManClipboard-150x150.jpg\" alt=\"ManClipboard\" width=\"150\" height=\"150\" srcset=\"https:\/\/www.bowditch.com\/bowditchrealestateblog\/wp-content\/uploads\/sites\/4\/2013\/09\/ManClipboard-150x150.jpg 150w, https:\/\/www.bowditch.com\/bowditchrealestateblog\/wp-content\/uploads\/sites\/4\/2013\/09\/ManClipboard-50x50.jpg 50w\" sizes=\"auto, (max-width: 150px) 100vw, 150px\" \/><\/a>When negotiating real estate transactions where environmental due diligence is proposed, this question is often asked: Who is required to notify the Department of Environmental Protection (\u201cMassDEP\u201d) if a release of oil or hazardous material is discovered above MassDEP reportable concentration levels during the Buyer\u2019s site investigations?\u00a0 Here is the short answer:<\/p>\n<p>Under G.L. c.\u00a021E, \u00a7\u00a07, and regulations at 310 CMR\u00a040.0331, the current owner or operator is required to give notice to MassDEP &#8220;as soon as he has knowledge of a release of threat of release of oil or hazardous material.&#8221; The &#8220;as soon as having knowledge&#8221; requirement is modified by MassDEP regulations that require notice within 2 hours, 72 hours or 120 days, depending on the nature of the contamination and certain site conditions and &#8220;knowledge&#8221; is defined in the regulations as not only &#8220;actual knowledge,&#8221; but &#8220;willful avoidance&#8221; of learning about the fact or facts in question 310 CMR 40.0300 and 40.0006.<\/p>\n<p>Licensed Site Professionals (\u201cLSPs\u201d) have no obligation under G.L. c.\u00a021E or the Massachusetts Contingency Plan (&#8220;MCP&#8221;) to notify MassDEP of a release of oil or hazardous materials. See 310 CMR\u00a040.0303.<\/p>\n<p>Separate from G.L. c.\u00a021E and the MCP are LSP Rules of Professional Responsibility. Under these Rules, LSPs are required<b> <\/b>to notify MassDEP of a release in limited circumstances where (1)\u00a0an imminent hazard has been identified, (2)\u00a0his or her client has been notified of a need to notify MassDEP of the imminent hazard, and (3)\u00a0the client has not provided such notice.<\/p>\n<p>This requirement, however, is not applicable to pre-acquisition environmental due diligence activities.\u00a0 The LSP\u2019s limited notification requirement under the\u00a0 Rules of Professional Conduct arises only when a LSP is providing \u201cprofessional services\u201d as that term is defined in 309 CMR\u00a02.02.\u00a0 \u201cProfessional services\u201d are not provided where, as is the case in most real estate transactions, an environmental professional is performing environmental due diligence investigations on behalf of a prospective buyer.<\/p>\n<p>Have a question?
