{"id":1558,"date":"2020-05-07T18:40:15","date_gmt":"2020-05-07T18:40:15","guid":{"rendered":"https:\/\/www.bowditch.com\/campuscounselnewengland\/?p=1558"},"modified":"2020-07-31T13:27:49","modified_gmt":"2020-07-31T13:27:49","slug":"what-massachusetts-businesses-need-to-know-about-masks-in-the-workplace","status":"publish","type":"post","link":"https:\/\/www.bowditch.com\/campuscounselnewengland\/2020\/05\/07\/what-massachusetts-businesses-need-to-know-about-masks-in-the-workplace\/","title":{"rendered":"What Massachusetts Businesses Need to Know about Masks in the Workplace"},"content":{"rendered":"<h2>Who must wear a mask and where?<\/h2>\n<p>The newest Massachusetts COVID-19\u00a0<a href=\"https:\/\/www.mass.gov\/doc\/may-1-2020-masks-and-face-coverings\/download\" target=\"_blank\" rel=\"noopener noreferrer\">Executive Order<\/a>\u00a0requires all individuals over the age of 2 to wear a mask or cloth face covering in places that are open to the public, effective May 6, 2020.\u00a0 The order applies to \u201call workers and customers of businesses and other organizations open to the public that are permitted to operate as\u00a0<a href=\"https:\/\/www.mass.gov\/info-details\/covid-19-essential-services\" target=\"_blank\" rel=\"noopener noreferrer\">COVID-19 Essential Businesses<\/a>.\u201d\u00a0 Inside grocery stores, pharmacies, and other retail stores, individuals must wear masks at all times.\u00a0 However, for most essential businesses, masks are only required when individuals are unable to maintain a distance of approximately six feet from every other person.\u00a0 Businesses that are categorized separately from grocery stores, pharmacies and \u201cother retail stores\u201d including banks are likely not subject to the more stringent requirement.<\/p>\n<p>There are a variety of\u00a0<a href=\"https:\/\/www.mass.gov\/doc\/guidance-for-face-masks-in-public-settings\/download\" target=\"_blank\" rel=\"noopener noreferrer\">individuals exempt from the mask-wearing requirement<\/a>\u00a0including but not limited to:<\/p>\n<ul>\n<li>Those who cannot breathe safely;<\/li>\n<li>Those who, due to a behavioral health diagnosis, are unable to do so;<\/li>\n<li>Those communicating with people who rely upon lip-reading; and<\/li>\n<li>Those who require supplemental oxygen to breathe.<\/li>\n<\/ul>\n<p>If an individual does not wear a mask for medical reasons, a business may not require the individual to provide documentation of the medical condition.\u00a0 However, a business may decline entry to a customer who refuses to wear a mask for non-medical reasons.<\/p>\n<h2>Must an employer provide masks?<\/h2>\n<p>Whether an employer is required to provide Personal Protective Equipment (PPE) to its employees varies by industry.\u00a0 While employers are obligated to comply with existing industry-based standards and provide their workers with industry-specific PPE, there is no new obligation created by the Occupational Health and Safety Act (<a href=\"https:\/\/www.osha.gov\/Publications\/OSHA3990.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">OSHA<\/a>) guidelines for an employer to provide masks in low-risk industries.\u00a0 A simple face mask or cloth covering is not the same as PPE for a healthcare worker.\u00a0\u00a0<a href=\"https:\/\/www.osha.gov\/dte\/outreach\/intro_osha\/7_employee_ppe.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">Employers are not obligated<\/a>\u00a0to provide non-specialty equipment that is \u201coften used outside the workplace and taken by workers from jobsite to jobsite and employer to employer,\u201d such as non-specialty safety-toe protective footwear or ordinary clothing such as winter coats. \u00a0In most business settings, non-medical cloth masks or face coverings would seem to fall squarely into this category as the risks associated with COVID-19 are not limited to the workplace.<\/p>\n<p>If a business chooses to provide masks for its employees, it is not likely to be liable for the quality of the mask.\u00a0 The Massachusetts Department of Public Health (DPH) and the Center for Disease Control (CDC) both discourage the use of medical masks in nonmedical settings, and encourage businesses to follow\u00a0<a href=\"https:\/\/www.cdc.gov\/coronavirus\/2019-ncov\/prevent-getting-sick\/diy-cloth-face-coverings.html\" target=\"_blank\" rel=\"noopener noreferrer\">CDC instructions<\/a>\u00a0for creating homemade masks.\u00a0 Neither the DPH nor the CDC provides any standards that homemade masks or face coverings must meet.\u00a0 While not required, if a business does provide masks, it should also provide training and\u00a0<a href=\"https:\/\/www.cdc.gov\/coronavirus\/2019-ncov\/communication\/print-resources.html?Sort=Date%3A%3Adesc\" target=\"_blank\" rel=\"noopener noreferrer\">post signage<\/a>\u00a0about how to properly use and wash masks and face coverings.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Who must wear a mask and where?
