{"id":2350,"date":"2024-07-15T14:35:11","date_gmt":"2024-07-15T18:35:11","guid":{"rendered":"https:\/\/www.bowditch.com\/campuscounselnewengland\/?p=2350"},"modified":"2024-07-22T14:24:56","modified_gmt":"2024-07-22T18:24:56","slug":"impact-of-title-ix-preliminary-injunctions-on-massachusetts-colleges-universities","status":"publish","type":"post","link":"https:\/\/www.bowditch.com\/campuscounselnewengland\/2024\/07\/15\/impact-of-title-ix-preliminary-injunctions-on-massachusetts-colleges-universities\/","title":{"rendered":"Impact of Title IX Preliminary Injunctions on Massachusetts Colleges &#038; Universities"},"content":{"rendered":"<h2>Update<\/h2>\n<p>On Monday, July 15, the plaintiff organizations Young America\u2019s Foundation and Female Athletes United filed the list of schools attended by their members.\u00a0 Moms for Liberty received an extension until July 26, 2024 to file their list of schools.<\/p>\n<p>Many public and private colleges and universities are on this list \u2013 including those in Massachusetts \u2013 and many more may be added as the court clarified in a ruling on Friday, July 19 that more schools could be added to these lists by the plaintiff organizations. We know that Young America\u2019s Foundation, for example, is actively recruiting new members with the promise to \u201cexempt your school from the Biden Administration\u2019s radical rewrite of Title IX.\u201d<\/p>\n<p>As to what to do as a campus counsel or Title IX Coordinator if your Massachusetts college or university is \u201con the list\u201d \u2013 we have not yet heard that any Massachusetts colleges or universities are hesitating in moving forward with compliance with the 2024 Title IX regulations by the August 1, 2024 deadline. The court\u2019s July 2, 2024 preliminary injunction memorandum explains that colleges are free to \u201cadopt or follow its own policies, or otherwise comply with applicable state or local laws or rules\u201d on Title IX. The impact of the preliminary injunction then is that the Department of Education is prohibited from forcing schools \u201con the list\u201d to comply with the 2024 Title IX regulations.<\/p>\n<p>Please reach out to your Bowditch attorney if your college or university is \u201con the list\u201d and you have questions about your ongoing Title IX compliance.<\/p>\n<hr \/>\n<p>As of July 15, 2024, fifteen states are under a preliminary injunction blocking enforcement of the 2024 Title IX regulations slated to take effect on August 1:<\/p>\n<ul>\n<li>Alaska<\/li>\n<li>Idaho<\/li>\n<li>Indiana<\/li>\n<li>Kansas<\/li>\n<li>Kentucky<\/li>\n<li>Louisiana<\/li>\n<li>Mississippi<\/li>\n<li>Montana<\/li>\n<li>Ohio<\/li>\n<li>Tennessee<\/li>\n<li>Texas<\/li>\n<li>Utah<\/li>\n<li>Virginia<\/li>\n<li>West Virginia<\/li>\n<li>Wyoming<\/li>\n<\/ul>\n<p>For colleges and universities in these states, they should continue complying with the 2020 Title IX regulations until the cases are decided or (although unlikely) the preliminary injunction is lifted or successfully challenged in the Circuit Courts.<\/p>\n<p>On July 2, 2024, the preliminary injunction announced by the U.S. District Court for the District of Kansas \u2013 affecting enforcement in Alaska, Kansas, Utah, and Wyoming \u2013 also impacts colleges and universities attended by any member of the <strong>Young America\u2019s Foundation<\/strong>, <strong>Female Athletes United<\/strong>, or attended by the minor child of a member of <strong>Moms for Liberty<\/strong>.<\/p>\n<p>As a result, this preliminary injunction could impact colleges and universities beyond these fifteen states currently enjoined.<\/p>\n<p>The plaintiff organizations \u2013 <strong>Young America\u2019s Foundation, Female Athletes United, and Moms for Liberty<\/strong> \u2013 are required to provide a list of schools attended by their members by July 15, 2024.\u00a0 Schools <em>do not<\/em> need to proactively determine whether their students are affiliated with those organizations. The federal judge \u2013 Judge John Broomes \u2013 will issue a ruling after that submission officially enjoining those particular schools from enforcing the 2024 Title IX regulations.<\/p>\n<p>Three other lawsuits against the regulations remain pending in courts in Alabama, Missouri, and Oklahoma. The Supreme Court\u2019s <a href=\"https:\/\/www.bowditch.com\/campuscounselnewengland\/2024\/07\/03\/client-alert-the-supreme-courts-chevron-decision-impacts-employers-particularly-in-healthcare-and-higher-education-industries\/\" target=\"_blank\" rel=\"noopener\">June decision in <em>Loper Bright v. Raimondo<\/em><\/a> is likely to impact how the lower courts will rule on cases challenging the 2024 Title IX regulations.<\/p>\n<p>Bowditch is watching these cases closely for any impact on our clients and colleges and universities in Massachusetts.
