{"id":459,"date":"2016-08-05T17:34:41","date_gmt":"2016-08-05T17:34:41","guid":{"rendered":"https:\/\/www.bowditch.com\/craftbrewerylegalblog\/?p=459"},"modified":"2020-07-31T13:29:14","modified_gmt":"2020-07-31T13:29:14","slug":"new-massachusetts-legislation-allows-nashoba-valley-winery-to-continue-operations","status":"publish","type":"post","link":"https:\/\/www.bowditch.com\/craftbrewerylegalblog\/2016\/08\/05\/new-massachusetts-legislation-allows-nashoba-valley-winery-to-continue-operations\/","title":{"rendered":"New Massachusetts Legislation Allows Nashoba Valley Winery to Continue Operations"},"content":{"rendered":"<p>Just before midnight on the deadline for its most recent session this past Sunday, July 31, the Massachusetts Legislature passed an economic development bill relaxing several restrictions on the sale of alcohol in the state, including a measure that will allow Nashoba Valley Winery in Bolton, Massachusetts to continue its operations.<!--more--><\/p>\n<p>We <a href=\"https:\/\/www.bowditch.com\/craftbrewerylegalblog\/2016\/06\/29\/nashoba-valley-winery-fights-for-its-existence-after-abcc-reinterprets-farmer-series-license-statutes\/\" target=\"_blank\" rel=\"noopener noreferrer\">reported in late June<\/a> on the plight of Nashoba Valley Winery, which after 13 years of being granted \u201cfarmer-series\u201d licenses for its winery, distillery, and brewery, as well as a pouring license for its onsite restaurant, was threatened with non-renewal of its licenses by the state Alcoholic Beverage Control Commission (ABCC). This spring the ABCC, for the first time, had interpreted the current licensing statute to prohibit simultaneously holding a pouring license and any farmer-series license, spelling doom for the business model of the small, family-owned business. The highly-publicized dispute caught the attention of several state officials, including Governor Charlie Baker, who stated that he <a href=\"http:\/\/www.wbur.org\/all-things-considered\/2016\/06\/28\/officials-nashoba-licensing-issue\" target=\"_blank\" rel=\"noopener noreferrer\">would support action to ensure the winery\u2019s operation<\/a>.<\/p>\n<p>That action came this week with the passing of <a href=\"https:\/\/malegislature.gov\/Bills\/189\/House\/H4569\" target=\"_blank\" rel=\"noopener noreferrer\">House Bill 4569<\/a>, which explicitly allows entities holding any combination of farmer-series winery, distillery, and brewery licenses to also obtain a pouring license to sell those beverages for consumption on the grounds of the farm \u2013 for Nashoba Valley, this means being able to continue serving its wines at its on-site farmhouse restaurant.
