Altitude Express, Inc.<\/em> to determine whether Title VII of the Civil Rights Act of 1964 prohibits discrimination on the basis of sexual orientation, and invited the submission of amicus curiae (\u201cfriend of the court\u201d) briefs on the issue from interested parties.\u00a0\u00a0 The Court\u2019s invitation was accepted:\u00a0 since May, more than ten amicus briefs have been filed with the Court, all in support of the (now-deceased) plaintiff, Donald Zarda, a former skydiving instructor who alleged he was wrongfully fired from his job because of his sexual orientation.<\/p>\n<p><!--more--><\/p>\n<p>Notable among the briefs filed is the <a href=\"https:\/\/assets.documentcloud.org\/documents\/3877684\/Companies-Brief-ca2-20170626.pdf\">En Banc Brief of 50 Employers and Organizations as Amici Curiae in Support of Plaintiffs-Appellants<\/a>. A few of these employers include Google, Microsoft, CBS, and Viacom.\u00a0 It is somewhat unusual for employers to request a more expansive interpretation of employment laws given the potential extra costs associated with compliance.\u00a0 The brief, however, forcefully asserts that prohibiting discrimination based on sexual orientation will positively affect the \u201cbottom line\u201d of companies, stating that the \u201cU.S. economy could save as much as $8.9 billion by protecting and welcoming LGBT employees in the workplace.\u201d<\/p>\n<p>If the Second Circuit decides that discrimination based on sexual orientation is unlawful under Title VII, it will be the first federal circuit court to do so following the Seventh Circuit\u2019s landmark decision in <a href=\"http:\/\/media.ca7.uscourts.gov\/cgi-bin\/rssExec.pl?Submit=Display&amp;Path=Y2016\/D07-28\/C:15-1720:J:Rovner:aut:T:fnOp:N:1801805:S:0\">Hively v. Ivy Tech Community College<\/a> (the subject of a recent <a href=\"https:\/\/www.bowditch.com\/diversityinclusionma\/2017\/06\/07\/seventh-circuits-en-banc-decision-in-hively-opens-door-for-transgender-protection-under-title-vii\/\">blog post<\/a> by Tim Powell).
