{"id":1363,"date":"2021-01-25T19:16:29","date_gmt":"2021-01-25T19:16:29","guid":{"rendered":"https:\/\/www.bowditch.com\/estateandtaxplanningblog\/?p=1363"},"modified":"2022-08-10T15:52:50","modified_gmt":"2022-08-10T19:52:50","slug":"are-your-unreimbursed-partners-expenses-deductible","status":"publish","type":"post","link":"https:\/\/www.bowditch.com\/estateandtaxplanningblog\/2021\/01\/25\/are-your-unreimbursed-partners-expenses-deductible\/","title":{"rendered":"Are Your Unreimbursed Partner\u2019s Expenses Deductible?"},"content":{"rendered":"<p>Since the Tax Cuts and Job Act of 2017 (TCJA) was passed, a little-known deduction for unreimbursed partner\u2019s expenses (UPE) has taken on more significance.<\/p>\n<p>Partner\u2019s in partnership and members of an LLC often incur significant out of pocket expenses for travel to conduct business with clients, professional education, seminars, professional dues, client entertainment, and expenses for maintaining a home office (assuming that the expense meets the definition of a deductible trade or business expense [ordinary, necessary etc.]). \u00a0Often the partnership will reimburse the partner or member for these expenses, and the partnership will claim these reimbursement as expense on their own <a href=\"https:\/\/www.irs.gov\/forms-pubs\/about-form-1065\" target=\"_blank\" rel=\"noopener\">tax return Form 1065<\/a>.<\/p>\n<p>In other cases, pursuant to the partnership, operating agreement, or policy of the firm, partners and members are expected to pay these expenses from their own funds.\u00a0 Prior to the TCJA, the partner or member would then deduct these (often significant) expenses on Schedule A as a miscellaneous itemized deduction. However, the TCJA suspended <a href=\"https:\/\/www.irs.gov\/publications\/p529\" target=\"_blank\" rel=\"noopener\">the ability to deduct miscellaneous itemized deductions<\/a> through the year 2025.<\/p>\n<p>Does this mean that the partner or LLC member has lost a valuable tax deduction for legitimate business expenses?\u00a0 The answer, as it often does, depends.<\/p>\n<p>There is a little-known exception that will allow a partner or member to continue to deduct these unreimbursed expenses. If these expenses are deductible, they are deducted directly on <a href=\"https:\/\/www.irs.gov\/pub\/irs-pdf\/i1040se.pdf\" target=\"_blank\" rel=\"noopener\">Schedule E<\/a> with the notation \u201cUPE\u201d, and offset the distributive share of income which is also reported on Schedule E.<\/p>\n<p>For these unreimbursed expenses to be deductible, the partnership or operating agreement (or firm policy) cannot provide for reimbursement (See T.C. Memo. 2011-289 McLauglan v.
