{"id":1708,"date":"2022-03-25T17:29:51","date_gmt":"2022-03-25T21:29:51","guid":{"rendered":"https:\/\/www.bowditch.com\/estateandtaxplanningblog\/?p=1708"},"modified":"2022-05-03T09:52:50","modified_gmt":"2022-05-03T13:52:50","slug":"the-irs-reminds-all-taxpayers-they-must-check-virtual-currency-box","status":"publish","type":"post","link":"https:\/\/www.bowditch.com\/estateandtaxplanningblog\/2022\/03\/25\/the-irs-reminds-all-taxpayers-they-must-check-virtual-currency-box\/","title":{"rendered":"The IRS Reminds All Taxpayers They MUST Check Virtual Currency Box"},"content":{"rendered":"<p>The <a href=\"https:\/\/www.irs.gov\/newsroom\/irs-reminds-taxpayers-they-must-check-a-box-on-form-1040-1040-sr-or-1040-nr-on-virtual-currency-transactions-for-2021\" target=\"_blank\" rel=\"noopener\">Internal Revenue Service recently issued a reminder that all taxpayers filing Form 1040, 1040-SR or 1040-NR must answer a question concerning virtual currency at the top of the tax return<\/a>.<\/p>\n<p>The question asks \u201cAt any time during 2021, did you receive, sell, exchange, or otherwise dispose of any financial interest in any virtual currency?&#8221; The taxpayer must check either \u201cyes\u201d or \u201cno.\u201d All taxpayers must answer this question even if they did not engage in virtual currency transactions.<\/p>\n<p>The IRS notice further explains when a taxpayer should answer \u201cyes\u201d versus \u201cno.\u201d<\/p>\n<h2>When taxpayers can check &#8220;No&#8221;<\/h2>\n<p><em>Taxpayers who merely owned virtual currency at any time in 2021 can check the &#8220;No&#8221; box<\/em> when they have not engaged in any transactions involving virtual currency during the year, or their activities were limited to:<\/p>\n<ul>\n<li>Holding virtual currency in their own wallet or account.<\/li>\n<li>Transferring virtual currency between their own wallets or accounts.<\/li>\n<li>Purchasing virtual currency using real currency, including purchases using real currency electronic platforms such as PayPal and Venmo.<\/li>\n<li>Engaging in a combination of holding, transferring, or purchasing virtual currency as described above.<\/li>\n<\/ul>\n<h2>When taxpayers must check &#8220;Yes&#8221;<\/h2>\n<p>The list below covers the most common transactions in virtual currency that require checking the &#8220;Yes&#8221; box:<\/p>\n<ul>\n<li>The receipt of virtual currency as payment for goods or services provided;<\/li>\n<li>The receipt or transfer of virtual currency for free (without providing any consideration) that does not qualify as a bona fide gift;<\/li>\n<li>The receipt of new virtual currency as a result of mining and staking activities;<\/li>\n<li>The receipt of virtual currency as a result of a hard fork;<\/li>\n<li>An exchange of virtual currency for property, goods, or services;<\/li>\n<li>An exchange\/trade of virtual currency for another virtual currency;<\/li>\n<li>A sale of virtual currency; and<\/li>\n<li>Any other disposition of a financial interest in virtual currency.<\/li>\n<\/ul>\n<p>Some experts warn that <a href=\"https:\/\/www.cnbc.com\/2022\/03\/23\/theres-a-tricky-virtual-currency-question-on-your-tax-return.html\" target=\"_blank\" rel=\"noopener\">taxpayers may be setting themselves up for bigger problems with the IRS if they answer incorrectly<\/a>.<\/p>\n<p><a href=\"https:\/\/www.bowditch.com\/estateandtaxplanningblog\/2017\/12\/13\/year-bitcoin-gains-subject-tax-irs\/\" target=\"_blank\" rel=\"noopener\">Taxpayers who disposed of cryptocurrency during the year will generally report gain or loss on Form 8949 and Schedule D<\/a>.<\/p>\n<p>We earlier discussed the <a href=\"https:\/\/www.bowditch.com\/estateandtaxplanningblog\/2021\/06\/23\/cryptocurrency-tax-update\/\" target=\"_blank\" rel=\"noopener\">IRS crackdown on cryptocurrency cheats<\/a>.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The Internal Revenue Service recently issued a reminder that all taxpayers filing Form 1040, 1040-SR or 1040-NR must answer a question concerning virtual currency at the top of the tax return.
