{"id":870,"date":"2019-07-18T18:12:50","date_gmt":"2019-07-18T18:12:50","guid":{"rendered":"https:\/\/www.bowditch.com\/estateandtaxplanningblog\/?p=870"},"modified":"2020-07-31T13:25:38","modified_gmt":"2020-07-31T13:25:38","slug":"blue-states-sue-over-federal-tax-law","status":"publish","type":"post","link":"https:\/\/www.bowditch.com\/estateandtaxplanningblog\/2019\/07\/18\/blue-states-sue-over-federal-tax-law\/","title":{"rendered":"Blue States Sue Over Federal Tax Law"},"content":{"rendered":"<p>On July 17, 2019, <a href=\"https:\/\/www.wsj.com\/articles\/three-states-sue-trump-administration-over-federal-tax-changes-11563392033\" target=\"_blank\" rel=\"noopener noreferrer\">three states filed a lawsuit<\/a> (subscription required) against the Trump administration over the Treasury Department\u2019s interpretation of changes to the tax code that were part of the Tax Cuts and Jobs Act (TCJA).<\/p>\n<p>TCJA placed limits on the deduction for state and local income tax (SALT), limiting these deductions to a maximum of $10,000.\u00a0 SALT deductions include state income and property taxes.<\/p>\n<p>Though most taxpayers across income categories received an income tax cut under TCJA because of the lower overall tax rates, some <a href=\"https:\/\/www.taxpolicycenter.org\/sites\/default\/files\/publication\/154006\/the_effect_of_the_tcja_individual_income_tax_provisions_across_income_groups_and_across_the_states.pdf?mod=article_inline\" target=\"_blank\" rel=\"noopener noreferrer\">higher-income residents<\/a>\u00a0of states such as\u00a0 New York and New Jersey that benefited from high SALT deductions were expected to see a tax increase.<\/p>\n<p>Elected officials in these states cried foul. New York Governor Andrew Cuomo went so far as blaming the federal tax law changes for an anticipated $2.3 billion-dollar budget shortfall as the <a href=\"https:\/\/www.cbsnews.com\/news\/ny-has-lost-2-3-billion-so-far-to-federal-tax-law-cuomo-says\/\" target=\"_blank\" rel=\"noopener noreferrer\">wealthy fled New York<\/a>.<\/p>\n<p>In response, some states, such as the three plaintiffs, proposed a workaround that would allow the establishment of charitable entities controlled by local governments that would circumvent the SALT limit, since charitable contributions do not have the same limitations.<\/p>\n<p>Essentially, a taxpayer in one of these states would make a contribution to the charitable entity and receive a tax credit on their state income or property tax.\u00a0 <a href=\"https:\/\/www.cpajournal.com\/2018\/12\/25\/the-irs-shutdown-of-salt-deduction-workarounds\/\" target=\"_blank\" rel=\"noopener noreferrer\">A summary of the various schemes can be found here<\/a>.<\/p>\n<p>However, in August of last year, the <a href=\"https:\/\/www.irs.gov\/newsroom\/treasury-irs-issue-proposed-regulations-on-charitable-contributions-and-state-and-local-tax-credits\" target=\"_blank\" rel=\"noopener noreferrer\">IRS issued proposed regulations<\/a> that would eliminate the benefits promised by these SALT workarounds, and in June 2019, these <a href=\"https:\/\/www.federalregister.gov\/documents\/2019\/06\/13\/2019-12418\/contributions-in-exchange-for-state-or-local-tax-credits\" target=\"_blank\" rel=\"noopener noreferrer\">regulations were finalized<\/a>.<\/p>\n<p>Now, <a href=\"http:\/\/d31hzlhk6di2h5.cloudfront.net\/20190717\/8c\/10\/dc\/de\/e08acc6c7ad4bbad959a7d1e\/2019_0717_SALT_Complaint_As-Filed.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">New York, Connecticut and New Jersey have sued<\/a> to have these rules overturned.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>On July 17, 2019, three states filed a lawsuit (subscription required) against the Trump administration over the Treasury Department&rsquo;s interpretation of changes to the tax code that were part of the Tax Cuts and Jobs Act (TCJA).
