Bob Young Quoted in Massachusetts Lawyers Weekly’s “Home inspectors deemed ‘employees’ for unemployment fund”
A recent District Court verdict found that a home inspection company, Tiger Home Inspection, must contribute to the state unemployment compensation fund for inspectors Tiger classified as independent contractors, saying these contractors were indeed considered employees.
When asked about the case, Bob Young said in the article:
Robert G. Young of Framingham said the statutory framework placed Tiger in an uphill battle from the start.
“The unemployment compensation statute has a ‘default’ position that individuals are employees and places the burden on companies to demonstrate that they are not employees,” Young said. “Just having the individual and the company agree [on independent contractor status] isn’t sufficient.”
