Bowditch Secures Unanimous Appellate Victory for General Contractor
Bowditch recently secured a unanimous appellate victory before the Rhode Island Supreme Court on behalf of a general contractor client. After obtaining a default judgment in the Rhode Island Superior Court against a subcontractor, the firm successfully defended the judgment on appeal. The Supreme Court unanimously affirmed the judgment, holding that the subcontractor failed to preserve its notice arguments for appellate review and finding no abuse of discretion in the trial court’s entry of judgment.
The decision reinforces the importance of complying with discovery obligations and procedural rules and demonstrates the courts’ willingness to uphold meaningful sanctions where parties fail to meet those obligations, providing valuable guidance for contractors and other construction industry participants involved in complex litigation.
