Overview

Andrew Bartholomew is a lawyer in the firm’s litigation group, helping clients resolve disputes involving real estate, construction, craft brewing, intellectual property and other business-related issues. Clients rely on Andy’s ability to adeptly navigate complicated laws, along with his advocacy skills, in order to achieve the best possible result. His experience spans a broad range of industries and issues, providing him with the perspective and the ability to handle the full spectrum of problems that a business of any size might encounter. Andy also contributes to the firm’s craft brewery blog, At the Bar with Bowditch.

Before Bowditch

Prior to joining the firm in 2017, Andy served as a Law Clerk to the justices of the Massachusetts Superior Court. He also previously worked as a Judicial Intern in the Massachusetts Appeals Court and the Massachusetts Superior Court. “This experience has made me better informed as a litigator,” Andy noted.

Besides work

Andy is an avid outdoorsman and hiker, with experience walking sections of the Appalachian Trail and making numerous trips to Acadia National Park in Maine.

Experience

Obtaining a Client’s Funds Held by a Large Investment Firm

A client came to the firm with a complex dispute involving members of his family and the investment firm that held a large portion of his life savings. On a time sensitive basis, Andy drafted a complaint and motion for preliminary injunction requesting that the Court order the investment firm to remove all restrictions on the client’s funds. Following a hearing, the Court granted the motion, allowing the client to freely access his savings and move them to another investment firm.

Assisting a Business Following a Taking by Eminent Domain

After the town had taken a portion of the client’s commercial property by eminent domain, Andy drafted a complaint seeking an assessment of damages, arguing that the monetary amount the town had offered to the client was not enough to compensate it for its loss. The town quickly agreed to negotiate for an additional payment, resulting in a favorable outcome for the client and allowing it to continue doing business, despite the taking.

Return of Down Payment

When a client’s attempted purchase of a home fell through, the seller inexplicably refused to return her deposit. Andy handled the case from cradle to grave, arguing the merits in District Court and ultimately receiving a judgment in the client’s favor for the full amount of the deposit, along with interest and costs.

Experience in the Trial Court Process

While he was a Law Clerk, Andy worked on a variety of criminal and civil cases in the Massachusetts Superior Court. He worked closely with the judges assigned to these cases and performed legal research and writing to assist their review. “The cases on which I worked required a lot of writing,” Andy noted, “which gave me first-hand experience with the trial court process.”
